1 · About these terms
These terms govern enquiries and engagements with John Kay Developments Limited (Company No. 04319325). Each engagement is additionally governed by our written proposal, which prevails over these terms where the two conflict.
2 · Services
We provide residential development consultancy: site and property appraisal, development planning support, project consultancy and design coordination. We act as independent advisers and are not building contractors, architects or estate agents.
3 · Fees and payment
Fees are fixed per stage and quoted in euros (EUR). Invoices are payable within 14 days. Secure payments are accepted via major card networks and payment institutions shown in our website footer. Work may be paused on overdue invoices after written notice.
4 · Cancellation and refunds
You may cancel an engagement before work begins by written notice at no charge. Once a stage has commenced, fees for work completed to the cancellation date remain payable, and any unused portion of a fixed-fee stage is refunded pro rata within 14 days. Reports and work-in-progress are released to you on cancellation where fees for them have been settled.
5 · Your responsibilities
You agree to provide accurate project information, timely decisions and access to documents reasonably required for the engagement.
6 · Advice and reliance
Our reports and advice are prepared for the named client and the specific project. Planning, cost and programme views are professional opinions formed with reasonable skill and care, not guarantees of outcomes.
7 · Liability
Nothing in these terms excludes liability that cannot be excluded under English law. Our total liability for any engagement is limited to the fees paid for that engagement, except where loss arises from fraud.
8 · Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
